Sussex Prosecutor – Cases Cleared: Resisting Arrest - DWI - Evading Police & More

Over the last 30-days the Sussex County Prosecutor’s office cleared the following cases against crimes within the area.

Sentencing of John A. Zaccaro

Zaccaro, age 46 of Little Falls, NJ, was sentenced to 180 days at the Morris County Correctional Facility.  He must also undergo DNA testing and pay mandatory fines and fees.

He pled guilty on October 22, 2019 to Operating a Motor Vehicle During a Period of License Suspension, a fourth degree crime.  Zaccaro admitted to operating, crashing and abandoning a motor vehicle in Hardyston during a period of suspension.

Plea of James A. Martin

Martin, age 53, of Pocono Lake, Pennsylvania, pled guilty to second degree Eluding, third degree Possession of a Controlled Dangerous Substance, fourth degree Driving While Suspended for a Second or Subsequent DWI and to a motor vehicle summons of Driving While Intoxicated.  Sentencing is presently scheduled for March 21, 2020.

The defendant admitted that in November when Stanhope Police effectuated a motor vehicle stop and pulled him over, he waited until the officer left his patrol vehicle and then took off and sped away at a high rate of speed putting other people in danger. He admitted operating his vehicle erratically, damaging it and eventually he stopped.  He also admitted to being in possession of cocaine, that he was driving while suspended for previous DWIs and was under the influence at the time. 

Sentencing of Fernando Diaz

Diaz, age 39, of Newton, was sentenced to three years in the New Jersey State Prison and Parole Supervision for Life.  He must also register for Megan’s Law and pay $1550.00 in court fines and fees.

He pled guilty on October 22, 2019, to Endangering the Welfare of a Child, a crime of the third degree and Contempt, a crime of the fourth degree. The defendant engaged in sexual conduct with a nine year old child on multiple occasions.  He also violated a court ordered restraining order prohibiting him from returning to the victim’s residence.

Sentencing of Larry Martin

Martin, age 39 of Wanaque, was sentenced to 36 months of probation.  He was ordered to complete 75 hours of community service work, submit a DNA sample, make restitution of $7,203.00 and pay fines and fees totaling $155.00.

He pled guilty on December 23, 2019, to Fraudulent Use of a Credit Card, a third degree crime. The defendant used a company issued credit card to make personal purchases between April and September 2019.

Sentencing of Timothy Garcia

Garcia, age 23 of Dover, was sentenced to three years of non-custodial probation concurrent with his sentence in Morris County.  He received jail credit of 84 days and was ordered to submit a DNA sample and pay fines and fees totaling $2,205.00.

He pled guilty on December 19, 2019, to two counts of Possession of a Controlled Dangerous Substance, a third degree crime. The defendant was in possession of oxycodone on June 27, 2019, in Hopatcong and cocaine on June 28, 2019, in Newton.

Plea of Christopher Rocco

Rocco, age 35 of Newton, pled guilty to Eluding, a third degree crime, and Driving While Intoxicated, a motor vehicle offense.  Sentencing is presently anticipated for March 6, 2020.

In pleading guilty, the defendant admitted to driving under the influence and attempting to elude a New Jersey State Police trooper on May 8, 2016, in Fredon Township, the case was investigated by Trooper M. Meehan of the New Jersey State Police.

Plea of Josue Jimenez-Guillen

Jimenez-Guillen, age 21 of Netcong, pled guilty to Joyriding, a fourth degree crime.  Sentencing is presently anticipated for March 6, 2020.

In pleading guilty, the defendant admitted to taking an individual’s motor vehicle without consent on November 7, 2019, in Stanhope. The case was investigated by Detective Joseph Johnson and officers of the Stanhope Borough Police Department.

Plea of Renee Tripp

Tripp, age 73, of Newton, pled guilty to Assault by Auto, a crime of the third degree, two counts of Disorderly Persons Assault by Auto and Motor Vehicle Summons Driving While Intoxicated.  She was sentenced on her Driving While Intoxicated charge to seven months loss of her driver’s license, she must complete twelve hours IDRC, have mandatory interlock on her vehicle and pay $1430.00 in fines and fees.

Sentencing is presently scheduled on her other charges for March 6, 2020. The defendant admitted she was had cocktails with her dinner and then drove intoxicated, resulting in a multi-vehicle accident with injuries.

Sentencing of Manuel Oliveira

Divito, age 23, of Wantage, was sentenced to three years New Jersey State Prison.  He must also pay $780.00 in court fines and fees and $880 in restitution to the victim(s).

 He pled guilty on August 19, 2019 to three counts third degree Burglary, two counts third degree Theft, one count fourth degree Theft and a Violation of Probation on a previous matter.

In 2019 the defendant broke into several homes and vehicles, throughout Sussex County, taking various items including jewelry and money.  He also was caught sneaking drugs in to the Keogh-Dwyer Correctional Facility.

Sentencing of Shayne D. Divito

Divito, age 23, of Wantage, was sentenced to three years New Jersey State Prison.  He must also pay $780.00 in court fines and fees and $880 in restitution to the victim(s).

He pled guilty on August 19, 2019 to three counts third degree Burglary, two counts third degree Theft, one count fourth degree Theft and a Violation of Probation on a previous matter.

Plea of Sky McDonough

McDonough, age 28, of Milford, Pennsylvania, pled guilty to Burglary, a crime of the third degree.  Sentencing is presently scheduled for March 6, 2020.

The defendant admitted he entered a private residence in Wantage, taking various items from the home.

Plea of Ryan J. Platt

Platt, age 21, of Highland Lakes, pled guilty to Possession of a Controlled Dangerous Substance, a crime of the third degree.  Sentencing is presently scheduled for February 14, 2020.

The defendant admitted he was in possession of Cocaine when questioned by New Jersey State Police when they responded to a report of an erratic driver and things being thrown out of a vehicle window.

Plea of Vincent Scardino, Jr.

Scardino, age 49, of Newton, pled guilty to Driving While Suspended for a Second or Subsequent DWI, a crime of the fourth degree and a Disorderly Persons charge of Obstruction.  Sentencing is presently scheduled for February 28, 2020.

The defendant admitted when he was stopped by Newton Police for a motor vehicle violation he was driving with a suspended license for a second or subsequent DWI.  He also admitted to failing to appear for several Court ordered appearances.

Sentencing of Brandon Soares

Soares, age 25 of Milford, Pennsylvania, was sentenced to two years of probation and ordered to pay fines and fees totaling $1,205.00.

He pled guilty on December 9, 2019, to Possession of a Controlled Dangerous Substance, a third degree crime. The defendant was in possession of heroin on August 9, 2019.

The case was investigated by Patrolman Brian Porter of the Sparta Township Police Department.

Sentencing of Dominick Hernandez

Hernandez, age 29 of Sparrowbush, New York, was sentenced to 60 days in the county jail, suspended, and three years of non-custodial probation.  He was ordered to submit a DNA sample and pay fines and fees totaling $155.00. 

He pled guilty on December 17, 2019, to Resisting Arrest, a third degree crime. The defendant used physical force against New Jersey State Police Troopers to prevent his arrest on July 3, 2019, in Montague Township.
